QB Mauk sues NCAA on eligibility (AP)

Mauk filed a lawsuit Wednesday against the NCAA less than a week after the association rejected his final appeal for another year of eligibility at Cincinnati The same day the lawsuit was filed Hardin County Judge William Hart in Mauk s home area of Kenton Ohio granted a temporary restraining order that says the NCAA cannot prevent him from practicing with the Bearcats The judge set an Aug 22 hearing on Mauk s request for a permanent injunction against the NCAA Mauk was a key player as Cincinnati rose to college football s Top 25 last season He says he should get another season because of playing time lost to injury while he was at Wake Forest Despite being a model student-athlete and person for the NCAA and despite having earned the NCAA significant revenues the NCAA has wrongfully arbitrarily and capriciously denied Mr Mauk s request to participate in a fourth year of athletic competition for reasons completely beyond Mr Mauk s control the lawsuit states Mauk wasn t at practice Thursday in West Harrison Ind Coach Brian Kelly told The Cincinnati Enquirer that he wouldn t risk using a player declared ineligible saying the school could have to forfeit games and give back bowl money That s ludicrous to even think that we would put him on the field and put our football team in harm s way Kelly said Cincinnati is preparing to open the season with senior Dustin Grutza who was replaced by Mauk last season Mauk said in a text message to The Associated Press that he couldn t discuss the lawsuit The NCAA was disappointed by the ruling a spokesman said We look forward to explaining more fully our reasons for the decision and the careful review given not only by our staff but also by representatives from our member schools spokesman Erik Christianson said in a statement Mauk came back from career-threatening injuries to lead Cincinnati last year to a No 17 ranking in the final poll He passed for 31 touchdowns and 3 121 yards even though his right arm and shoulder were still in pain Mauk broke the arm and separated the shoulder in Wake Forest s season opener in 2006 then transferred to Cincinnati He appealed to the NCAA for an extra year of eligibility because of the injuries but was turned down A second appeal claiming he redshirted his freshman year at Wake Forest in part because of different injuries also was rejected Mauk then went to the NCAA s reinstatement committee which ruled last week there wasn t enough medical documentation to support his claim that he missed his freshman year because of injury His lawsuit says it s not his fault that files weren t maintained The NCAA allows up to two medical exemptions meaning a student-athlete could be eligible for six years with a legitimate reason said Mauk s attorney Kevin Murphy We believe the NCAA has treated Ben differently than it has other athletes with very very similar circumstances Murphy said Murphy said the NCAA denied Mauk s request for a hearing and that Mauk s surgeon told the NCAA he needed nine months to heal after a March 2003 surgery making him unable to play later that year The facts are that he only got to play three years Murphy said

Shuttle bus mess makes getting to the game tougher

Tesco, Tata Target Indian Grocery Market

A deal to launch a wholesale cash-and-carry business in India ends years of speculation but initial expectations are modest by James Thompson Tesco ended years of speculation yesterday by signing a deal to launch a wholesale cash and carry business in India but said that sales would initially be modest The grocery giant is to open its first cash and carry outlet in Mumbai by the end of next year but it will open further distribution hubs in Delhi and Bangalore that will deliver food and non-food products to 12 million small owner-run stores or kiranas as well as other small retailers restaurants hoteliers and catering businesses The fascia of the cash and carry has not yet been decided but it will include the Tesco name Tesco is also entering into a deal with Trent the retail arm of the Tata Group to supply products services and expertise to its hypermarket business Star Bazaar in the burgeoning Indian retail market where sales could double to 370bn by 2015 However Philip Clarke Tesco s international and IT director stressed that the revenues Tesco delivers from India would be fairly small initially and declined to comment on profitability timeframe The deal sends a powerful signal about Tesco s global ambitions and follows the collapse of negotiations with Bharti Enterprises in 2006 Given that global retail rival Wal-Mart signed a deal with Bharti in late 2006 and the German retail and wholesale giant Metro Group already has a cash and carry business in India Tesco s launch plans will ease concern that it might have been losing ground in India Under Indian foreign direct investment FDI regulations multi-brand foreign retailers are not allowed to sell directly to consumers in retail stores but they can run wholesale operations and provide infrastructure support services to local companies as Tesco is doing with Tata While it is unclear if the Indian authorities have any short-term plans to relax the FDI regulations industry experts expect it to eventually happen Mr Clarke said If and when it changes we will have a wholesale business and our association with Tata will give us great experience in India Mr Clarke said that Tesco had been plotting its entry into India for 10 years The Shore Capital analyst Darren Shirley said We view this as a sensible deal for Tesco with a strong partner in Tata which has existing retail capability and strong local knowledge of the Indian market whilst it will enable Tesco to begin the development infrastructure and supply chain which is one of the current constraints of the Indian market to modern retail practices Asked if he expected protests from kiranas Mr Clarke said People will judge us not by what we say but what we do India has a growingpopulation of 1 1 billion which is expected toovertake China by 2025 Mr Clarke said that of the cash and carry s products up to 40 per cent will be non-food such as electrical devices and cooking equipment but sales volumes will be heavily weighted towards food Trent s Star Bazaar which will be supplied by Tesco s cash and carrybusiness has four hypermarkets and wants to ramp this up to 50 over the next five years although Tesco will not feature on the fascia Tesco s overseas expansion 149 Tesco launched the Fresh Easy convenience store chain in the US in November 2007 After sprucing up the stores and introducing more brands this summer trade at Fresh Easy is gathering momentum as it seeks to realise ambitions of up to 1 000 stores along the west coast from San Diego to Seattle Tesco now operates 71 stores in Southern California Arizona and Nevada 149 The supermarket launched in China in 2004 and now has 56 stores in the country of which the overwhelming majority are hypermarkets In the year to end of February Tesco said it delivered strong sales in China including good like-for-like growth and a modest profit 149 Tesco entered South Korea in 1999 but the scale of its ambitions in the country became clear in May when it acquired 36 Homever hypermarkets from the E-Land Group for 958m Samsung Tesco now has more than 66 Homeplus hypermarkets and 72 Homeplus Express stores in South Korea 149 The UK company now has operations in 12 countries excluding India outside Britain which also include the Czech Republic Hungary Poland Republic of Ireland Slovakia Turkey Thailand Malaysia and Japan Given its strong position in the UK grocery market Tesco expects its international division will deliver a large chunk of its sales growth over coming years

Shares of J C Penney Macy s and other retailers have rebounded in the wake of lower oil prices But with consumers squeezed is it just a blip Getty Images by Ben Steverman For a year consumer discretionary stocks have been Wall Street pariahs In the face of a slowing economy an awful housing market and spiking energy prices few investors wanted exposure to the sector which sells products and services mdash from clothing to airline tickets mdash that Americans want but don t necessarily need But now suddenly consumer stocks have bounced back in a big way Overall the Standard amp Poor s 500-stock index s consumer discretionary sector is up 17 in the past month and almost 10 in the five trading sessions ended Aug 11 The main reason is oil Crude oil peaked at 147 72 per barrel on July 3 but it has fallen to below 114 per barrel more recently Prices at U S gas pumps have fallen 26 days in a row according to the American Automobile Assn That s down 7 from a record high of 4 114 per gallon on July 16 Double-Digit Percentage Gains Lower energy bills for American consumers have helped the whole sector but the effect has been striking for many retailers beaten down by the stock market J C Penney JCP may be down 42 from a year ago but more recently its stock has jumped 19 in one week Home Depot HD and Lowe s LOW have been punished by the weak housing market but their stocks are up 22 and 18 respectively since oil s peak As crude has fallen from its record Macy s M shares rose 17 Amazon com AMZN jumped 22 and Sears Holdings SHLD owner of the Sears and Kmart chains gained 24 Consumer discretionary stocks pared some of those gains Aug 13 after retail sales figures were slightly weaker than expected For investors looking ahead the key question is whether consumer discretionary stocks and big retailers in particular can continue their run of good luck Good News from Key Companies Optimists can point to the fact that despite all the economic pressure on the U S consumer retail spending hasn t fallen off a cliff Retail spending excluding autos has risen between 0 8 and 1 2 each month since March In July retail sales excluding autos rose 0 4 short of economists expectations for a 0 5 increase quot Even when oil was at 140 a barrel consumer spending was slowing but not stopping quot says Michael Yoshikami president and chief investment strategist at YCMNET Advisors Another positive factor has been recent news from some key companies Many investors were fearing the worst from consumer discretionary outfits earnings reports and what they got was hardly good With most results in Thomson Reuters TRI estimates second-quarter earnings of S amp P 500 consumer discretionary companies will fall 57 from a year ago However David Cumberland senior research analyst at R W Baird says many firms are doing a surprisingly good job controlling inventories and protecting profit margins For example Kohl s KSS said Aug 7 that sales fell 2 4 in July but the stock rose in the following days after the retailer stated it should still be able to hit profit expectations Kohl s shares are up more than 25 in the past month
